Personal Data Protection Policy

1.- INTRODUCTION

Machu Picchu Premium Travel E.I.R.L. is a company in the tourism sector located in the Urb. Zaguan del Cielo I-3, Cusco, and is obliged to comply with current Peruvian legislation on the protection of personal data, Law No. 29733 Protection of Personal Data and its complementary provisions.

Machu Picchu Premium Travel declares that it has a firm commitment to the protection, security and privacy of its users. The personal information that is collected about your customers is used for the purpose of contacting you if necessary. Machu Picchu Premium Travel does not  collect personal information about its customers for purposes other than those stated and does not sell, negotiate or rent personal information to any organization.

2.- OBJECTIVE

The purpose of this document is to establish principles, uniform practices and responsibilities regarding the processing of personal data in which Machu Picchu Premium Travel is involved.

3.- SCOPE

This document is applicable to all the processes of Machu Picchu Premium Travel that will use personal data of customers intended to be contained in the different databases of Machu Picchu Premium Travel and to the processing of these.

The Policy will be known and fully complied with by all Machu Picchu Premium Travel workers and suppliers.

4.- COMPLIANCE OFFICERS

Machu Picchu Premium Travel will assign and communicate the corresponding responsibilities to all staff and suppliers, for compliance with this Policy.

The area responsible for annually reviewing this Policy and making the respective adjustments within Machu Picchu Premium Travel will be the General Management. Likewise, said Management will be in charge of resolving any queries related to the application and scope of this Policy.

Notwithstanding the foregoing, all employees of Machupicchu Premium Travel, as well as all suppliers and third parties with whom Machupicchu Premium Travel is linked in the regular exercise of its business and have access to or process personal data are subject to compliance with the Policy.

5.- TRANSFERS OF PERSONAL DATA

The personal data processed by Machu Picchu Premium Travel may only be assigned or transferred to third parties for the fulfillment of the purposes related to the legitimate interest of the assignor and the assignee and with the prior, express, free, unequivocal and informed consent of the owner of the personal data. Such consent shall not be required in the cases permitted by law.

6.- CONSENT AND LEGITIMACY OF PROCESSING

Machu Picchu Premium Travel processes user data:

  1. When they expressly consent to the processing of their personal data for the purposes detailed in this document and/or;
  2. when the processing is necessary for the performance of a contract for the provision of services and products to which the user is a party.

7.- COLLECTION OF SENSITIVE DATA

Machu Picchu Premium Travel will only collect personal data and/or sensitive data when strictly necessary and in compliance with the principles of purpose and proportionality. When the collection and processing of such data derives from compliance with a legal obligation, Machu Picchu Premium Travel will inform the owner of the data of such situation prior to its collection.

8.- PERSONAL INFORMATION WE COLLECT

The information collected and stored includes basic data entered through registration, contact or other similar forms; such as, for example, name, ID, passport, gender, age, telephone number, email address, country of residence, among others, data collected through the various channels that the company manages, necessary for the provision of the tourist services of Machu Picchu Premium Travel.

9.- DISCLOSURE OF PERSONAL DATA

Machu Picchu Premium Travel will not disclose personal data to third parties except when:

  1. a) It is necessary for the purpose for which the personal data was collected; as well as in the provision of services through third parties and suppliers.
  2. b) The personal data subject is informed prior to disclosure or at the time of collection of personal data.
  3. c) The owner of the personal data gives his/her prior and express consent.
  4. d) Consent is not required by law.
  5. e) The personal data is required by public entities within the scope of their legal competences and attributions.
  6. f) The personal data is necessary to satisfy legitimate requirements of a company interested in acquiring any of the operations of Machu Picchu Premium Travel, with the prior consent of its owner; or,
  7. g) Access to personal data by auditors and lawyers and other professionals bound by professional secrecy.

10.- DELETION OF PERSONAL DATA

Once the processing of the personal data has been completed and the principle of purpose has been complied with, and provided that there is no legal mandate or reason that justifies the retention of the personal data, Machu Picchu Premium Travel will proceed to delete them from its records.

11.- COOKIE INFORMATION:

A Machupicchu Premium Travel makes use of Cookies, which are text files sent by the platform to your computer and stored there, which contains information related to the navigation of the website. In short, Cookies are used to improve the user experience.
